Purchase contract & one year health guarantee

If there is something in the contract that you do not understand or do not agree with please feel free to discuss it with me and we may be able to come to an agreement on this subject.

This is a new contract so please feel free to let me know if you feel something is unfair or just to give me your insite.

We reserve the right to refuse placement of one of our babies to anyone at any time for any reason that I feel is in the best interest of our babies.

If I do not find you suitable for any reasons, than I do not have to place a puppy with you. If at any time during the process of waiting, I find that you have become an unsuitable home for one of my puppies, for any reason whatsoever, than I do reserve the right to return your deposit to you and remove you from the waiting list. I am very particular as to where my babies go. All of my decisions regarding where my babies are placed are made with the puppies best interest at heart

The Seller (Tina Ortiz) reserves the right of first refusal if the Purchaser decides he/she no longer wants to remain responsible for said dog/pup ______

THERE WILL BE NO THIRD PARTY PLACEMENTS WITH FULL AKC, IF PURCHASER IS UNABLE TO KEEP THE PUPPY/DOG AND BREEDER IS UNABLE TO TAKE BACK AT THAT TIME....

THE PUPPY/DOG MAY ONLY BE PLACED TO ANY 3RD PARTY AS A PET ONLY AND NO THIRD PARTY FULL AKC REGISTRATION IS ALLOWED UNDER ANY TERMS OF THIS AGREEMENT...

DEPOSIT

Deposits are 200.00 to 300.00 dollars depending on the cost of the puppy and may be up to half of the price of the puppy you are purchasing. The balance of your puppy must be paid in full at the time of pick up of the puppy. No checks are excepted at pick up

Your deposit is NON REFUNDABLE and NON TRANSFERABLE for any reason other than if MY vet feels the puppy is not healthy enough to be placed

HEALTH GUARANTEE

--This puppy is being sold for pet purposes only, with limited or no AKC registration (seller's discretion), and is not intended for breeding. Puppy must be spayed/neutered at six months of age unless a licensed veterinarian feels the puppy is still to small at this time and should wait until puppy is bigger______

--The Buyer agrees to never sell or give this puppy to any other private party, pet shop, puppy mill, or similar institution. _____

--In the event that buyer no longer can care for the puppy buyer agrees to contact seller to be apart of placement approval for puppy. _____

--Seller states at time of sale or shipment (whichever is closest to the dog leaving sellers care) that it is healthy and free of any disease nor afflicted with any illness. _____

--The buyer has 72 hours from purchase (three working days) to take the dog to a licensed veterinarian to have a complete health check. Failure to do so will void the health guarantee. If at that time there is a problem found then buyer is to contact seller at once. Seller will not be responsible for any vet bills incurred in the check or the treatment of this dog. _____

--We do not guarantee the coloring, temperament, size, coat, personality, conformation or breeding capabilities of this puppy. _____

--All puppies have been vaccinated, and dewormed before leaving our home. Proof of vaccination will be provided in the form of vet shot record from the Sellers Vet. _____

--This puppy is / is not sold on a spay/neuter contract which will be signed prior to puppy leaving. _____

--This health guarantee is in affect for 1 (one) year from the date of birth, for LIFE THREATENING congenital birth defects ONLY, such as heart, lung, kidney, and liver defects, if documented by a licensed Veterinarian, within year from the date of puppy?s birth. Seller has the right to a second opinion from licensed veterinarian of sellers choice. _____

--The buyer shall take full responsibility for this puppy and its actions. We assume NO responsibility for this puppy once it leaves our home; be it vet bills, landlords disapproval, allergy to animals, disagreement of family members, impulse buying, housebreaking problems, medical problems of the buyer or buyers family members, personal and property damage. PLEASE think twice before buying a puppy. They can live up to 20 years and beyond. _____

--We do not cover your expenses. After this puppy leaves our home, the buyer is responsible for ALL VET BILLS; including, but not limited to, physicals, vaccinations, medications, blood tests, x-rays, ultrasounds, surgeries, autopsies, boarding, grooming, etc. The buyer must pay these bills no matter what the circumstances are. _____

--We are not obligated to replace a puppy whose problem is a result of its new environment; including, but not limited to, change of diet, lack of vaccinations, deworming, grooming, neglect, general health care, etc._____

-- If it is found that there is abuse or neglect to this puppy, puppy will be removed from buyers possession and placed back with seller with no refund. _____

--We do NOT cover ANY infectious diseases including, but not limited to, Parvo virus, Corona virus, Distemper, and Kennel Cough, because these can be contracted immediately after leaving our home. _____

--We do NOT cover ANY Parasites. All of our puppies are dewormed, usually at least twice, prior to leaving our home, however, it is possible that a parasite could survive and further treatment may be necessary. If this is the case, it is the buyers? responsibility to obtain this treatment from their Veterinarian. _____

--We do NOT cover Hypoglycemia, low blood sugar, because this can be triggered from the stress of a new environment not recieving the proper nutrition, and/or other factors. Small breed puppies can be easily susceptible to this and it can be controlled if properly cared for. _____

--This health guarantee does NOT cover any problems associated with Luxating Patellas (sliding kneecaps), undescended testicles in males (unilateral or bilateral cryptorchidism), under/over bite of the teeth, hernias or any other condition that is NOT a life threatening congenital birth defect. You will be informed at time of sale if we are aware of any of these conditions. If we are not aware and this problem develops, this is the buyers responsibility. _____

--If this puppy is to be returned for one of the medical reasons covered in this guarantee, we must be notified within 24 hours after the examination. We will then offer the buyer an exchange if one is available. If an exchange is not available then the buyer will be given an agreed upon puppy of equal value from an upcoming litter. NO REFUNDS will be given. _____

--An exchange will only be given if the puppy is still covered by the one year health guarantee and only AFTER we have received all medical records, test results, Veterinarian statements with a confirmed diagnosis, and a notice of death from the buyers? Veterinarian (if applicable). Name, address and phone number of veterinarian must be given to seller with your permission to speak directly to your vet about the puppy in question, All Vet papers must be provided to transfer ownership of the puppy back to us. _____

--It is the buyers? responsibility to transport the puppy back to us. Transportation costs are the responsibility of the buyer, such as gas, airfare, etc. _____

--To be covered by this guarantee the said puppy must be owned by the person who originally purchased the said puppy from the breeder (seller). The said puppy must have all times received proper nutrition, current vaccinations, regular worm vaccinations including heart worm prevention, and yearly veterinarian visits (proof will be required of vet services). Also puppy must be raised in a healthy living environment and receive proper exercise. _____

--In the case of an untimely death of this puppy, an autopsy MUST be performed by a licensed Veterinarian to find the cause of death. If a confirmed diagnosis of the puppies? birth defect was made while the puppy was still alive, then an autopsy is not needed. It is the buyers? responsibility to arrange and pay for the autopsy. **If death was foretold by medical testing, autopsy MAY not be required. ______

BREACH OF CONTRACT

This comes into effect when either party refuses, declines or deliberately breaks any of the terms set forth in this contract.

If any condition or term is broken by buyer then seller will not delay in taking the appropriate steps to rectify the situation.

In the event of any legal actions arising from or in connection with this agreement, buyer will be responsible for all attorney and legal fees.

Jurisdiction and/or venue of any litigation arising out of or related to this contract shall lie exclusively in the county and state in which seller (Tina Ortiz) resides at the time of purchase.
